

BRAZIL – Regulations allow foreign sports betting and online gaming operators
Brazil’s Secretary of Prizes and Betting of the Ministry of Finance (SPA/MF) published yesterday Monday (6/5) in the Official Gazette of the Union SPA/MF Ordinance No. 722, of May 2, 2024, highlighting technical requirements that must be observed by future operators in the sports betting and online gaming (bets) segment under Laws 13,756/2018 and 14,790/2023. This is another step taken by SPA/MF in the process of regulating “bets” operations in the country, but it does not represent approval of any operator at this stage.
According to SPA/MF, this new Ordinance is part of a set of regulations intended to discipline the performance of sports betting operators in Brazil and aim to give more security to local citizens operating sports-themed betting or online games.
Regulation SPA/MF Ordinance No. 722/2024 sets out the technical and security requirements of betting systems, as well as their sports betting and online gaming platforms. The specified technical requirements refer to the technology infrastructure of the betting systems, which must be met by all future authorized operators or agents.
All operators must keep betting systems and respective data in data centres located in Brazilian territory, as determined by the Ordinance. As exceptions, there is the possibility that systems and data may be operated and recorded outside the country, but under specific regulations criteria, they must be sited in countries that have an International Legal Cooperation Agreement with Brazil, in civil and criminal matters jointly, and provided that within the determinations of the General Data Protection Law (LGPD) – Law No. 13,709/2018 all conditions are observed.
With the publication of regulations set out in SPA/MF Ordinance No. 722/2024, transparency criteria is established, regarding the safety of the betting public. “The operator shall, at any time, grant full access to the betting systems to personnel and inspection agents of Brazil’s Secretariat of Prizes and Bets of the Ministry of Finance.”.
With the objective of allowing effective inspections, the regulation imposes on the operators the obligation of forwarding to SPA/MF all data related to bets, bettors, bettors’ wallets, legal destinations and other information of their operation, according to the periodicity and format established in the SIGAP Manual, which will be available on the SPA website. In addition, and without prejudice to the previous provisions, the Secretariat of Prizes and Betting may, at any time, request additional information from the operator, as set out in the regulations.
Also, the electronic channels used by the operator in a virtual environment must use the “bet.br” domain registration, according to specific regulations.
