瑞波案仍須等待最終裁決
法院雖在 7 月 13 日裁定，稱瑞波在交易所賣幣的「計畫性銷售（programmatic sales）」並不符合判斷投資契約的 Howey Test 所述。
但是 Ripple Labs 所進行的機構銷售確實讓 XRP 構成證券，這代表瑞波案部分指控仍需等待法院作最終裁決。
FOX Business 記者 Eleanor Terrett 也引用了解 SEC 內部的匿名消息指出，除了對瑞波兩大高管撤銷指控外，瑞波案的其它指控，包括投資契約、代幣銷售分配等仍待定奪，說 Gary Gensler 不戰而降似乎太早了。

SEC 並無法立即上訴
曾是 CNBC Crypto Trader 主持人的 Ran Neuner，他對瑞波案的評論遭到大量糾正，推文超過 800 則留言。
他推文稱：
為什麼幣圈在慶祝 SEC 撤告？之前他們必須等待案件結束，但現在他們可以立即上訴，聰明一點。
這馬上被 Eleanor Terrett 反駁：
SEC 必須在最終判決出爐後才能上訴，這需要好幾個月的時間，這代表 SEC 最快也要等到明年才能上訴。

CoinDesk 也指出，瑞波與 SEC 還需要針對價值 7 億美元的非法 XRP 銷售展開鬥爭，雖然瑞波團隊的負擔已經減經不少，但聲稱 SEC 已經以某種方式投降的假設絕對是錯的。
