Tennessee’s sports betting industry is going through a period of change, dealing with tax adjustments and uncertain revenue patterns. The Sports Betting Council (SBC) has recently renewed licenses for popular operators like BetMGM, DraftKings, FanDuel, and Action 24/7, allowing them to keep operating in the state. However, with changing tax rates and revenue fluctuations, the future of sports betting in Tennessee is uncertain.

One of the biggest changes in Tennessee’s sports betting arena is the shift in tax rates. Previously, the state imposed a 20% tax on the sportsbooks’ earnings. Now, the SBC has implemented a 1.85% tax on the total amount wagered, aiming for a more stable and predictable income for the state. This change is meant to increase revenue and ensure a fair distribution of funds.

The impact of this tax adjustment becomes clear when looking at revenue numbers. In September, Tennessee saw a significant increase in wagers, reaching $420 million compared to $337 million in 2022. However, despite this surge, the state collected $1 million less in taxes on sports betting in September 2023 than it did in September 2022. This difference raises concerns about the effectiveness of the new tax structure and its ability to generate the expected revenue.

The allocation of tax funds is another important aspect of Tennessee’s sports betting landscape. The Lottery for Education program, which received $65.7 million from sports betting last year, greatly benefits from these funds. Additionally, 80% of sports betting taxes go towards supporting education in the state, providing vital resources for educational initiatives. Furthermore, 15% of the taxes collected from sports betting are given to local governments, allowing them to invest in their communities. Another 5% is dedicated to mental health programs, recognizing the importance of supporting well-being with the growing popularity of sports betting.

While the new tax structure aims to improve revenue stability, the SBC’s reporting practices have made it difficult to assess the true impact of the current system. The lack of transparency hinders public understanding of how the tax changes affect revenue collection. SBC Executive Director Mary Beth Thomas claims that Tennessee has collected more taxes in 2023 compared to the previous year. However, it’s important to note that under the old system, the state collected more taxes in the first six months of 2023. These contrasting figures highlight the complexities of the changing tax landscape and the need for a thorough evaluation.

Looking ahead, the SBC will present future revenue estimates at the upcoming November 6 revenue estimating meeting of Tennessee’s State Funding Board. These projections will provide valuable insights for policymakers and industry stakeholders, giving an idea of expected revenue trends and guiding decision-making processes.
