Virginia is currently at the centre of a heated debate over the legalization and expansion of gambling in the state. Dueling legislative proposals backed by different gambling companies have sparked controversy, with one side advocating for an expansion of slot-like betting machines known as “gray machines,” and the other side expressing concerns about the potential negative effects of such a move.

At the heart of the debate are the so-called “gray machines,” arcade-style games that resemble slot machines but involve an element of skill, according to their manufacturers. These machines have been a source of contention for years, as policymakers have struggled to regulate them amidst fierce opposition from the casino industry. Currently, they are prohibited in Virginia under a ban passed in 2020.

A well-organized coalition, including influential legislators and retail owners who host the machines, is backing a proposal to legalize and tax the devices. One of the bill sponsors, Senator Aaron Rouse, argues that this is a small-business issue that could help first-generation Americans achieve the American dream. The bill aims to set up a regulatory structure overseen by Virginia’s ABC agency, with limits on the number of machines allowed in licensed establishments such as restaurants and truck stops. Proponents of the bill estimate that it could generate over $200 million in annual revenue for the state.

Critics of the proposed gambling expansion, particularly the state’s casinos, have raised several concerns. They argue that the machines are associated with crime and can lead to gambling addiction, especially among vulnerable populations. Critics also express unease about the scale of the expansion, which could potentially result in a significant increase in the number of machines across the state. They contend that the current proposals lack sufficient oversight and safeguards.

Virginia is not the only state grappling with the issue of skill games. Similar debates have emerged in various parts of the country as these machines have gained popularity. While only a handful of states have fully legalized them, the discussion surrounding their regulation and taxation continues to be an ongoing topic of interest.

In addition to the bill supporting the legalization of skill games, another proposal has been put forth by Senator Jeremy McPike. This alternative bill not only seeks to legalize skill games but also aims to open the door for video terminals that resemble traditional slot machines. McPike’s bill proposes stricter oversight and regulation, including third-party inspections and taxation at a higher rate. The proposed revenue projections for this bill are also significant, reaching the hundreds of millions per year.

Both bills acknowledge the authority of local governments to ban the machines within their jurisdictions. However, McPike’s bill requires local governments to make a decision regarding the machines by January 1, 2025, providing a timeline for their potential prohibition.

Both proposals have garnered support from industry players. Pace-O-Matic, a skill games producer, has contributed significant campaign donations to legislators in recent years and is backing the bill sponsored by Senator Rouse. On the other hand, J&J Ventures and Accel Entertainment, gaming machine operators, are supporting Senator McPike’s bill. These industry stakeholders believe that allowing both skill games and video terminals to compete on equal terms will provide small businesses with maximum choice.

The proposed bills have faced different paths through the legislative process. Rouse’s bill has enjoyed special treatment, bypassing the committee typically responsible for vetting gambling-related bills and proceeding directly to the finance committee chaired by influential legislator Senator L. Louise Lucas. McPike’s bill, on the other hand, has encountered obstacles and has not yet received a full hearing.

The fate of these proposals ultimately lies with Governor Glenn Youngkin. His spokesperson has stated that the governor will review any legislation related to gambling that reaches his desk. It remains to be seen how the governor will approach this complex issue and what impact his decision will have on the future of gambling in Virginia.
