美國老牌交易所 Kraken 繼今年 2 月遭 SEC 指控未註冊質押服務後，再次遭 SEC 提起民事訴訟，情況與此前的 Coinbase 相當類似。

SEC 再次提告 Kraken

據法律文件，SEC 提出多項指控：

• 混淆用戶、交易所資金

• 未註冊經紀商、清算機構及交易商

• 上架大量未註冊證券 (ALGO、MATIC、NEAR)

文件指出，Kraken 混淆高達 330 億美元的用戶、交易所資金；同時未註冊經營經紀商、交易商，也與稍早起訴的幣安、Coinbase 非常類似。

SEC 照舊列出了許多 Kraken 上架的代幣，聲稱都是未註冊證券，將對 Kraken 處以罰款，並要求永久禁止 Kraken 作為未註冊交易所運作。

Kraken：抗爭到底

Kraken 對此發佈專文，強調會與 SEC 在法庭上抗爭到底，其反駁了 SEC 所有指控，並引用了瑞波訴訟作為案例，聲稱 SEC 的理論在法庭上根本行不通。

Kraken 現任執行長 Dave Ripley 也轉推了專文。他表示：

我們強烈不同意 SEC 的指控，堅定認為我們並未上架證券，並計劃大力捍衛我們的立場。SEC 一再要求交易所進行註冊，但美國並沒有明確的註冊途徑，我們將勇敢面對所有指控。

Kraken 創辦人 Jesse Powell 也對 SEC 的指控感到意外，他以為 Kraken 此前向 SEC 繳納 3,000 萬美元罰金後，事情就能告一段落了。

他抨擊道：

訊息很明確，10 個月前 Kraken 的 3,000 萬美元罰金能讓 SEC 律師準備很多事情，現在再敲詐一次，SEC 很清楚一場真正的法律戰可能會花超過 1 億美元並耗費大量時間，如果無法負擔，請帶著你的加密企業離開美國戰區。
