California efforts to legalize sports betting via the November ballot in 2024 have come to an end, but the conversation surrounding this issue continues.

Proponent Kasey Thompson, who initially aimed to unite the tribes, decided not to move forward without their support. Despite some public backing from non-gaming tribes, the California Nation Indian Gaming Association (CNIGA), which includes powerful tribes like the Morongo Band of Mission Indians, Pechanga Band of Luiseno Indians, and San Manuel Band of Mission Indians, remained steadfast in their opposition.

Even major commercial operators, including FanDuel Sportsbook, DraftKings Sportsbook, Fanatics Sportsbook, and BetMGM, through the Sports Betting Alliance (SBA), came out against the initiatives. SBA spokesperson Nathan Click clarified that they would not provide financial support for the signature gathering process or otherwise support the sports wagering initiatives.

While the 2024 initiatives faced significant obstacles, many believe that the pathway to legalizing sports betting in California must be tribe-led. The alignment of major gaming tribes and operators against the initiatives indicates the need for a united approach moving forward. CNIGA chairman James Siva suggests that California may not be able to legalize sports betting until 2028. Additionally, tribes may opt for an incremental approach, focusing on in-person sports betting before venturing into online platforms.

The regulatory framework implemented by the New Jersey Division of Gaming Enforcement ensures fair competition, consumer protection, and responsible gambling measures. By studying successful models like New Jersey, California can develop a regulatory framework that addresses the unique needs and challenges of the state.

To pave the way for legalized sports betting in California, several steps must be taken. First and foremost, it is crucial to engage in open and transparent discussions with all stakeholders, including tribes, commercial operators, lawmakers, and the public. This dialogue will help address concerns, build consensus, and lay the foundation for a united approach.

Next, a comprehensive regulatory framework must be developed, taking into account the unique characteristics of the state. This framework should include provisions for licensing, taxation, consumer protection, responsible gambling measures, and enforcement. Drawing upon successful models from other states, California can tailor its regulations to ensure a safe and fair sports betting environment.

Additionally, education and awareness campaigns should be implemented to inform the public about the benefits and potential risks of sports betting. These campaigns can help dispel myths, promote responsible gambling behavior, and provide resources for individuals who may develop gambling-related problems.
