Two Former GVC Executives Launch Legal Action

Two former high-ranking executives of GVC Holdings (now known as Entain Plc) have initiated legal proceedings against the UK Gambling Commission (UKGC). Kenny Alexander, the ex-CEO, and Lee Feldman, the former Chairman, have filed a case under the “Part-53 of the Media and Communications Claims” category. This legal challenge, which alleges “misuse of private information.”

The lawsuit, filed through the London-based law firm Slateford, marks a significant escalation in the ongoing tension between the former GVC leadership and the UK’s gambling regulator. While the specific details of the allegations remain shrouded in mystery.

The roots of the current legal dispute can be traced back to a significant event in the gambling industry landscape. In a move that caught many by surprise, FS Gaming, an investment vehicle led by Kenny Alexander, made a strategic play to acquire control of 888 Holdings (formerly known as Evoke Plc). This ambitious attempt involved purchasing a 6.5% stake in the London Stock Exchange-listed gambling group.

This situation prompted the UKGC to launch an investigation into the proposed acquisition. The regulatory body was particularly interested in understanding the implications of Alexander’s potential return to a leadership position in a major gambling company, especially given the unresolved issues from his time at GVC.

The management of 888 Holdings, understandably cautious about the proposed changes in ownership and leadership, raised several questions about Alexander’s intentions. Of particular concern was Alexander’s plan to increase his shareholding and potentially step into the role of CEO. Additionally, there were indications that Lee Feldman might assume the position of chairman if the acquisition were to succeed.

In response to these developments, 888 Holdings requested clarification from FS Gaming regarding their intentions and plans. However, the company described the response they received as providing “only the most basic assurances.” This lack of detailed information further fuelled concerns about the proposed acquisition and its potential implications for 888 Holdings’ future.

Following the announcement of the UKGC’s review and after careful consideration of all available information, the board of 888 Holdings made a unanimous decision to terminate discussions regarding the proposed acquisition.

The Entain Settlement: A Related Development

In a related development that further complicated the situation, Entain (formerly GVC Holdings) reached a substantial settlement with the Crown Prosecution Service. This settlement, amounting to £585 million, was related to a bribery investigation involving the company’s former Turkish business, which had been sold in 2017.

The financial implications of this settlement were significant, resulting in corporate losses of £900 million on Entain’s 2023 accounts.

Potential Motivations Behind the Lawsuit

The decision by Kenny Alexander and Lee Feldman to file a legal challenge against the UK Gambling Commission raises several questions about their motivations and objectives. Some possible factors that might have influenced this action include:

  1. Perceived Reputational Damage: The executives may feel that the UKGC’s actions and statements have unfairly tarnished their professional reputations.
  2. Disagreement Over Regulatory Approach: There could be fundamental disagreements about the UKGC’s regulatory methods and decisions, particularly concerning the review of 888 Holdings’ licenses.
  3. Seeking Clarification on Regulatory Boundaries: The lawsuit might be an attempt to establish clearer guidelines on what information regulators can use and how they can use it when making decisions.
  4. Personal Vindication: Alexander and Feldman may be seeking to clear their names and challenge what they perceive as unfair treatment by the regulatory body.

The Role of Slateford Law Firm

The choice of Slateford, a London-based law firm, to represent Alexander and Feldman is significant. Slateford specializes in media and communications law, suggesting that the case may involve complex issues related to information dissemination and privacy rights.
