In an effort to overturn a pivotal 2022 decision by U.S. District Judge Edward Davila, Apple, Meta, and Google have banded together to issue a warning to the 9th U.S. Circuit Court of Appeals about potential dangers to the whole internet economy. The Communications Decency Act’s Section 230, which shields internet publishers from responsibility for third-party material, is at the core of the decision. The IT titans express worry that the decision might hold online platforms accountable for handling users’ purchases of virtual chips in casino gaming applications, endangering the whole internet economy.


Battle Over Section 230 Protections


Cross-appeals have resulted from the casino app lawsuits, with Apple, Meta, and Google contesting the ruling that they would be held liable for handling payments for virtual chips. The plaintiffs’ attorneys from the Edelson law firm filed cross-appeals on their rejected claims on the opposite side.


The platforms contend that Judge Davila erred in his interpretation of a significant ruling by the 9th Circuit because, if his judgment is upheld, it may subject several websites that allow in-app purchases, such as Spotify and Substack, to accountability for any allegedly illegal goods.


The argument advanced by the plaintiffs in the casino app case has raised concerns from representatives of Apple, Meta, and Google that it is “limitless” and may enable “clever lawyers” to reframe claims that would otherwise be protected by Section 230. They stress that they did not design the virtual chips or the programs themselves; rather, their involvement as a publisher was confined to acting as a payment processor.


Although the HomeAway case established the principle that Section 230 does not supersede local regulations, the tech titans emphasize that the casino app instances are significantly different, making the consequences of the decision all the more important.


The appeals process is still underway and is anticipated to be finished by December 2023. The outcome will have significant ramifications for the internet economy and how Section 230 rights for online platforms are interpreted. Without a doubt, the result will influence how online liability and accountability is seen in the future.
